Имед3: Андрей, сейчас в Республике идет очень серьезная работа по формированию сената. Выполнены два критерия Конвенции. Речь идет о том что правительство и парламент приступили к реализации комплекса мер по юридической имплементации критерия Конвенции касающегося постоянного населения страны. Какую позицию сегодня занимает МИД РОС?
Ответ: Позиция не менялась и направление понятно. Правительство Республики работает, мы в это понятие сегодня включаем уже и двухпалатный парламент провозглашенный премьером, в который входят уже утвержденные сенаторы, работают министерства. Мы вместе с ПКА сейчас отрабатываем вопрос согласования правительственной позиции по подготовке необходимого для имплементации положений Конвенции закона "О постоянном населении РОС".
Имед3: Надо ли понимать это так, что правительство в широком смысле планирует утвердить юридический факт наличия в Республике постоянного населения? Как будет реализована эта концепция на ваш взгляд?
Ответ: Министерство юстиции РОС сегодня исходит из того, что нашей стране необходим юридический документ, будь то акт парламента или декрет правительства, который устанавливал бы юридический порядок функционирования постоянного населения. Как министр иностранных дел я хочу подчеркнуть что правительство страны является подотчетным парламенту, и его формирование еще не завершено. Поэтому министр юстиции сама может внести через премьер министра этот акт в будущий парламент, или такой закон может быть внесен кем то из сенаторов.
Имед3: Хотя бы коротко - кто составит постоянное население новой страны?
Ответ: Как в любой демократической стране, (а РОС - именно демократия, и сенатор Михайловский достаточно ясно это показал в своем интервью для нашего блога 15 июня т. г. - Имед3) мнения на эту тему уже сегодня совершенно разные. Прежде всего существует концепция минюста, предусматривающая что к составу постоянного населения будут относиться такие субъекты - физические лица, которые имеют нечто вроде вида на жительства, грин карты. Вторая концепция принадлежит ПКА, согласно этой идее главенствующую роль в этом вопросе будет отдана экономической теме - если ты имеешь например счет в финансовой системе РОС, ты имеешь право на жительство, как субъект общности под названием постоянное население с юридическими правами принадлежащими субъекту такой общности, а если проявляешь долгосрочную экономическую активность - получаешь права гражданства. И граждане и лица имеющие вид на жительство в этой концепции будут считаться частью постоянного населения. И есть сенатский концепт закона: мы сразу законом включаем в состав постоянного населения всех министров, включая премьера и сенаторов. Это будет первым "вкладом" в состав постоянного населения РОС. И далее будут рассмотрены вопросы о том кого эти жители в лице своего представительного органа будут "принимать в состав" постоянного населения РОС. В любом случае эти юридические акты должны быть и будут точно соответствовать положениям критерия Конвенции Монтевидео 1933 года о наличии в любой стране постоянного населения для получения ей субъектности.
